Title Documents for the Foundry Site (March 2022)
In March 2022, when the Foundry Site was purchased from the Province of Ontario by the deGasperis family, a lot of new documents were attached to the property at the Land Registry Office. Here they are:
- Parcel Registers - the overall list of Instruments (documents) attached to the Land Title for each Block as of December 2022
- For Block 26, the northwest corner (Foundry Cleaning Room)
- For Block 17, the rest of the Foundry Site
- Plan 66R-32516 - detailed survey showing the different parts of the Site
- Land Transfer - documenting the actual transfer of ownership from the Province to Eastern Avenue (Condos)
- Notice of Reciprocal Agreement - sets out the relationship between Eastern Avenue (Condos) and Eastern Avenue (Rentals)
- Restricted Covenant and Participation Agreement - two instruments relating to a covenant between Eastern Avenue (Rentals) and the Province regarding the affordable housing part of the deal
- Notice of Option to Purchase (Rental) - relates to the rental portion on Block 17. Documentation seems to have been drafted September 1, 2020 (see version reference at the bottom of the first page of the actual Option to Purchase, page 4) and citing the Agreement of Purchase and Sale dated October 23, 2020, one day after the MZO was issued
- Provincial Contribution Agreement - sets out the terms of the Affordable Housing deal between the Province and Eastern Avenue (Rentals)
- Heritage Conservation Agreement - references the June 2021 HIA extensively
- Participation Agreement (Market Lands)
- Notice of Option to Purchase (Market) - relates to the market portion on Block 17 and to Block 26. Documentation seems to have been drafted September 1, 2020 (see version reference at the bottom of the first page of the actual Option to Purchase, page 4) and citing the Agreement of Purchase and Sale dated October 23, 2020, one day after the MZO was issued
- TD Bank Debenture - relating to a $100 million mortgage from TD Bank
- Charge by Partnership - clarifications of relationship between Eastern Avenue (Rentals) and Ministry of Municipal Affairs and Housing
- General Assignment of Rents - allows the Ministry of Municipal Affairs and Housing to collect rents
